President Biden Sent Spinning By Multiple Lawsuits – Joe May Have Committed Major Violation By Stopping Border Funds
When Joe Biden took office in January, everyone knew former President Donald Trump’s most controversial project was in trouble. After all, Democrat leaders had been trying to stop it for years.
So, nobody was really surprised when Biden halted funding for the southern border wall. State leaders weren’t too happy with the result, though, as they’ve complained of huge foreign surges ever since.
And as it turns out, the President might’ve committed a serious violation.
That’s what Rep. Jason Smith from the House Budget Committee alleges — in a letter obtained by The Daily Caller, Smith called on state attorneys general to take legal action against Biden.
Smith believes he has a case, too.
When Biden froze border wall funds, Smith says POTUS may have violated the Impoundment Control Act of 1974, “which reasserted Congress’ sole authority over budgetary spending.”
If accurate, the President might face some difficult questions.
As Smith wrote:
As previous legal opinions from the GAO on similar matters have noted, the withholding of congressionally appropriated federal funds for a policy reason may result in a violation of the Impoundment Control Act of 1974.
The Republican representative went on to say that Trump specifically allocated those funds for the border wall. Then this was essentially overruled, which Smith claims is “overreach and abuse of the separation of powers.”
Basically, Smith wants state attorneys general to take swift action.
This is because the GAO investigated the issue back in March, but decided that Biden didn’t exceed his presidential authority. However, Smith and other Republicans still disagree.
And if enough state leaders take the plunge and level this legal accusation at Biden’s office, that could yield results.
In June, Biden rerouted $2 billion, previously set aside for the border wall, back to the Department of Defense. The problem is, border authorities say this was a huge mistake.
The border crisis continues to be a serious issue, and taking billions away from the problem might not have been the best course of action.
Previously, various state governors and other leaders have accused President Biden of several violations in regards to his border decisions. And they continue to point toward gaping holes in our border defenses.
On top of that, it appears as if Vice President Kamala Harris, originally tapped to deal with the problem, hasn’t done much.
Therefore, maybe it is time for state attorneys general to heed Rep. Smith’s call, and go after Biden for this potential violation. It might be the only way to reclaim some necessary funding.
